NUEVA PUBLICACIÓN sobre GIBRALTAR Y LA NEGOCIACIÓN DEL NUEVO TRATADO TRAS EL BREXIT, del Dr. Alejandro del Valle 29 octubre 2021
El Dr. D. Alejandro del Valle Gálvez, Catedrático de Derecho Internacional Público en la Universidad de Cádiz, Director del Centro de Excelencia Jean Monnet “Inmigración y derechos humanos en las fronteras exteriores europeas” y titular de la Cátedra Jean Monnet «Inmigración y Fronteras», ha realizado la siguiente publicación: “GIBRALTAR TRAS EL BREXIT: EN BUSCA DE UN NUEVO ESTATUTO INTERNACIONAL CON LA UE Y CON ESPAÑA. NEGOCIANDO EL TRATADO RU-UE SOBRE GIBRALTAR”.
Tras el referendo ‘Brexit’ de 2016, y la salida efectiva de RU de la UE en febrero de 2020, Gibraltar se encuentran en una situación de redefinición y búsqueda de un nuevo estatuto internacional y europeo para su relación con la UE y con España. Diversos Tratados y acuerdos vinculados a la salida británica están regulando esta nueva situación. En todos ellos España debe dar su conformidad previa a la aplicación del Derecho UE a Gibraltar, mediante negociaciones con Reino Unido.
En este trabajo se analizan las problemáticas esenciales que plantea Gibraltar en su relación con España, como es la reclamación histórica de la soberanía. Igualmente, los aspectos de cooperación transfronteriza en su evolución y necesidades actuales. Este trasfondo permite luego analizar el Tratado de Retirada RU-UE de 2019 y la previsión existente respecto a Gibraltar, que es una novedosa vía de colaboración en el marco UE, centrada en la cooperación transfronteriza. Se trata de mecanismos vinculados que se prevén en el Protocolo del Tratado de Retirada de 2019 (Hard Law), y en Memorandos de Entendimiento-MOUs (Soft Law) acordados entre RU y España; y que regulan y encauzan el tratamiento de la cooperación transfronteriza con Gibraltar, de manera provisional tras la Retirada de RU,
Posteriormente se analizan las previsiones del importante Tratado RU-UE específico sobre Gibraltar, en fase de negociación. Un Principio de Acuerdo-hispano británico de 31.12.2021 ha permitido a la Comisión adoptar una Recomendación de Mandato negociador en Julio de 2021, que llevará a abrir formalmente las negociaciones RU-UE para un Tratado que regulará con permanencia el nuevo estatuto de Gibraltar en su relación con la UE y con España. Se realiza una comparación entre el Acuerdo de Principio y el Mandato negociador, y se valora la viabilidad de también las negociaciones, habida cuenta de las variadas problemáticas que se plantean. Entre estas, destaca la incorporación del territorio de Gibraltar al Área Schengen bajo la responsabilidad de España, el desmantelamiento de los controles fronterizos en la Verja / Frontera, o la aplicación de reglas aduaneras y comerciales, con una estructura institucional propia de gobernanza que debe aún acordarse. Cuando se celebre, este Tratado permitió blindar gracias a la UE un modelo original de cooperación trasfronteriza estable con Gibraltar, abriendo perspectivas futuro para la cooperación en otros ámbitos de la controversia histórica.
After the Brexit referendum of 2016, and the effective exit of the UK from the EU in February 2020, Gibraltar is in a situation of redefinition and search for a new international and European status for its relationship with the EU and Spain. Several treaties and agreements linked to the British exit are regulating this new situation. In all of them, Spain must give its prior consent to the application of EU law to Gibraltar, through negotiations with the United Kingdom.
This paper analyzes the essential issues raised by Gibraltar in its relationship with Spain, such as the historical claim of sovereignty. Likewise, the aspects of cross-border cooperation in its evolution and current needs. This background allows then to analyze the UK-EU Withdrawal Treaty of 2019 and the existing forecast regarding Gibraltar, which is a new way of collaboration in the EU framework, focused on cross-border cooperation. These are linked mechanisms provided for in the Protocol to the 2019 Withdrawal Treaty (Hard Law), and in Memoranda of Understanding-MOUs (Soft Law) agreed between the UK and Spain; and which regulate and channel the treatment of cross-border cooperation with Gibraltar, on a provisional basis after the UK’s Withdrawal,
Subsequently, the provisions of the important UK-EU Treaty specific to Gibraltar, currently under negotiation, are analyzed. A UK-Spanish Principle of Agreement of 31.12.2021 has enabled the Commission to adopt a Recommendation for a negotiating mandate in July 2021, which will lead to the formal opening of the UK-EU negotiations for a Treaty that will permanently regulate the new status of Gibraltar in its relationship with the EU and Spain. A comparison is made between the Agreement in Principle and the Negotiating Mandate, and the feasibility of the negotiations is also assessed, given the various issues that arise. Among these, the incorporation of the territory of Gibraltar to the Schengen Area under the responsibility of Spain, the dismantling of border controls at the Verja / Border, or the application of customs and trade rules, with its own institutional structure of governance still to be agreed. When it is concluded, this Treaty allowed to shield thanks to the EU an original model of stable cross-border cooperation with Gibraltar, opening future prospects for cooperation in other areas of the historical dispute.
